During the title search it is discovered that one of the sellers has filed bankruptcy and was titled on the property before it was devised in the parents will. A bankruptcy attorney/title agent that is licensed to practice in bankruptcy court can easily get the information needed to determine if the property was part of the bankruptcy and whether the delinquent taxes were forgiven or paid off in the bankruptcy proceeding.
Now what? The child support lien presents another challenge. We understand Family law and the complex issues of a court-ordered child support obligation. By interviewing the person with the child support lien, we can determine if the child support lien was recorded in error or can it be cured by filling the appropriate pleadings in the family court case.
Another wrinkle . . . is that the will was not probated. Now what? Can the sellers sell? Who owns the property? An attorney that practices in probate court will easily navigate to get the appropriate affidavits and tie up the loose ends of a probate case.
